Terms & Conditions (T&C)

1. Scope

These Terms & Conditions (T&C) apply to all orders placed by consumers (§ 13 BGB) via our online store.

The product presentation in the shop does not represent a legally binding offer but a non-binding invitation to place an order. By clicking the “Buy Now” button, you submit a binding purchase offer. The contract is concluded once we accept your order via an order confirmation or shipping confirmation email.

4. Prices & Payment

All prices are final prices and include the applicable VAT.

Shipping costs: €4.99 per order. Free shipping applies once the order value shown in the shop is reached.

Payment methods: PayPal, Klarna, and credit card via Shopify Payments. The terms of the respective payment service providers apply.

5. Delivery

Delivery area: worldwide. Delivery time is usually 2–15 business days. For international deliveries (e.g. from non-EU countries), customs clearance may cause delays. Any customs duties or import fees are the responsibility of the customer.

6. Right of Withdrawal (Overview)

Consumers have a statutory right of withdrawal of 14 days. Details, requirements, and consequences can be found in our Right of Withdrawal Policy.

Important: Please do not return goods without prior contact. Email us at em.performancede@gmail.com and we will provide the correct return address and instructions. Return shipping costs are borne by the consumer unless otherwise agreed.

The goods remain our property until full payment is received.

8. Warranty

The statutory warranty rights apply.

9. Liability

We are fully liable for intent and gross negligence. For slight negligence, we are only liable for breaches of essential contractual obligations (cardinal duties) and for damages resulting from injury to life, body, or health. Otherwise, liability is excluded to the extent permitted by law.

10. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final Provisions

The law of the Federal Republic of Germany applies. Should any provision of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
